GUEST RENTAL AGREEMENT

 

This agreement is made this date {BCRE} between Lyle & Katherine Hendricks dba Clearwater Cabin Rental (we) as owner of the premises located at 429 Neff Road (the Cabin) and Guest to rent the premises under the terms listed. Guest must sign and return a copy of these rules within 5 business days for the reservation to be confirmed. Please return via email (info@ClearwaterCabinRental.com), or regular mail (507 Neff Road, Orofino, ID 83544) or through our secure online platform.

 

RESERVATIONS

All reservations require a 50% deposit. There is a two-night minimum. We accept Visa, Mastercard, Discover, and American Express. Full payment of all bookings made with more than 30 days prior to reservation must be received no later than 30 days  prior to arrival. If full payment is not received 30 days prior to arrival, Guest will forfeit any monies paid and the reservation may be canceled with or without notice. Reservations made with less than 30 days remaining before arrival must be paid in full. Guest must be 25 years of age to make a reservation. Upon receipt of deposit payment and signed rental agreement, reservation will be confirmed via email or regular mail. Rates do not include 8% sales and lodging tax.

 

CANCELLATIONS

We have a strict policy so it is up to Guest to purchase trip cancellation insurance. If Guest reservation is cancelled for any reason, Guest will forfeit all monies paid at the time of cancellation.

We are not responsible for acts of God. We cannot be responsible for winter weather conditions, so when Guest makes winter reservations, make sure that you have proper equipment (tires, etc.) to drive in the snow and carry tire chains. If the Cabin is not available due to an act of God and we must cancel the reservation, Guest will receive a full refund. If the Cabin is not available at 4:00 p.m. upon arrival, due to excessive cleaning by departing guests, Guest will receive $25 credit for each hour the Cabin is not available.

 

CHECK IN/CHECK OUT TIMES

Check-in time is 4:00 p.m. Check-out time is 11:00 a.m. Guest will be given Directions and a lockbox code which is located by the front door of the cabin to retrieve the key upon receipt of fully completed Agreement and final payment.

 

ACCOMMODATIONS / CLEANING

The Cabin will come equipped with the basic necessities when renting a home. Basic supplies of sheets and towels, hand soap, toilet paper, dish soap are provided along with house wares. The Cabin will be cleaned before and after each reservation. The Guest shall leave the Cabin  as clean as upon arrival. All furniture and items should be returned to their original location. Do not make beds that have been slept in. Excessive cleaning will be charged to Guest credit card at $25/hour with a one-hour minimum. Excessive cleaning is considered anything beyond changing bed linens, laundering linens, dusting, vacuuming and cleaning the bathroom. If excessive cleaning interferes with the reservation of an arriving guest, $50/hour will be charged to allow for $25/hour credit to arriving guest.

 

WELL AND SEPTIC SYSTEM

 

Clearwater Cabin Rental is on a well and septic system. The septic system is very effective; however, it will clog if improper material is flushed. DO NOT FLUSH ANYTHING OTHER THAN TOILET PAPER. No feminine products are to be flushed at any time. If Guest clogs the system, Guest may be charged the service fee to have it cleared.

 

MAXIMUM OCCUPANCY / ADDITIONAL GUEST FEE

Rates are based on double occupancy. Guests must pay an additional fee for guests over two people, including infants and children. The number of Guests occupying this Cabin is limited to six. These limits are strictly enforced. Exceeding maximum occupancy or not paying the extra guest fee, except where specifically authorized, will be grounds for immediate eviction and forfeiture of all funds paid. No R.V.s on premises without prior written approval and absolutely no tents. Each approved additional Guest over two Guests will be charged $25 per night per Guest for a minimum of two nights. An expected total Guest count per night is required at the time of reservation. Guest may be charged without notice for additional Guests not disclosed to Clearwater Cabin Rental for all nights of the reservation to Guest credit card.

 

SMOKING IS NOT ALLOWED

Smoking is not permitted inside or on the decks of the Cabin. Extra care to extinguish cigarettes must be taken in dry weather conditions. Guest will be responsible for any extra cleaning charges including, but not limited to, carpet, furniture, draperies or bedding needed because of smoking. If smoking has occurred in the Cabin, there will be a $200.00 cleaning fee. In addition, if extra time is required to pick up butts on the property grounds, Guest will incur an additional fee of $50.00. These fees will be charged to Guest credit card.

 

PETS (DOGS ONLY)

A pet fee (at the current rate) will be charged, limit of two pets. Pets are not allowed on any furniture or beds and cannot remain alone inside the Cabin uncrated. Guest is responsible for any additional cleaning or replacement of furnishings required due to occupancy of pets which shall be charged to Guest credit card. If it is found that there are more or different pets than agreed to on the premises, Guest credit card will be charged without notice $100 per undisclosed pet and Guest may be asked to vacate immediately with no refund. 

 

LOST/NON-RETURNED KEYS

All keys must be returned at time of Check-Out. Guest is responsible for lost keys and the associated costs. The property must be re-keyed in the event that keys are lost, misplaced or not returned. All associated costs will be charged to Guest credit card.

 

MAINTENANCE AND REPAIRS

 

We strive to maintain the Cabin in the finest condition. Please report inoperative equipment. We will make every effort to have repairs/replacements made as quickly as possible. We cannot guarantee that the appropriate repair/replacement can be made in a timely manner for circumstances beyond our control. Items which do not warrant any refund of rental monies include but are not limited to the following: (1) TVs, radios and other recreational devices that breakdown during Guest stays; (2) Power Outages during Guest stays; (3) Adverse road conditions or weather conditions.

 

RISKS/SAFETY

Children are welcome, however, there may be conditions in and around the unit that may pose a hazard to them as well as to adults. We do not assume any liability or responsibility for any injuries occurring during Guest stay. Children must be supervised at all times.

INDEMNIFICATION

Guest agrees to indemnify and hold Lyle and Katherine Hendricks dba Clearwater Cabin Rental free and harmless for any liabilities or any loss or damages whatsoever arising from, related to, or in connection with rental of premises. This includes, but is not limited to, any claim or liability for personal injury or damage or loss of property, which is made, incurred or sustained, by Guest or members of the Guest party, or any persons Guest permits on the property.

 

SPECIAL CHARGES

(1)Carpet cleaning is subject, but not limited to a $50 cleaning fee.

(2)No vehicles are permitted beyond gravel boundaries. Ruts off gravel areas are subject, but not limited, to a $50 landscaping fee.

(3)If Guest leaves an item behind and we find the item, Guest will be responsible for shipping charges. We do not accept responsibility for lost, stolen or damaged guest items.

(4)Delay charges will apply if Guest Damages or Excessive Cleaning results in a delay of check-in time for arriving guest(s) at the rate of $50/hour.

(5)It is not possible to list every circumstance that may result in a charge as a result of Guest stay. Special charges may include but are not limited to replacement of damaged or missing items or loss or delay of use for subsequent guests.

 

 

TERMINATION OF RENTAL

We reserve the right to refuse or discontinue tenancy if in its opinion the Guest is detrimental to the property. Any violation of the above-mentioned policies will result in immediate eviction and loss of entire rental and deposit amounts.

 

SECURITY AND DAMAGES

A credit card verification is agreed by Guest/Cardholder when signing this agreement. Card not charged unless charges are assessed as a result of Cardholder or their Guest stay. Cardholder/Guest is responsible for any/all damages incurred by him/her or members of the Guest party, or any persons Guest permits on the property. Guest agrees that they are responsible to pay the full replacement cost of damaged or missing items. Please advise immediately of any damages so that we can get working on replacements for the next guests and so Guest avoids charges for Delay Charges.

CREDIT CARD (DEBIT CARDS NOT ACCEPTABLE FORM FOR DEPOSITS)

Guest is providing a credit card number or check as a guarantee and for payment of rents. Guest agrees to pay all rent and/or any other fees associated with this rental, accept all terms of this rental agreement and accept liability for any damage during the term of the stay with Clearwater Cabin Rental. If Guest fails to do so, Guest understands that these costs will be charged to the provided credit card and all such sales are final. Any damages found upon arrival or occurring during Guest stay must be reported immediately to us. Guest will be responsible for any unreported damages or theft.

 

ATTORNEY’S FEES AND COSTS

 

If Clearwater Cabin Rental employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, the eviction of the Guest, or because Guest takes any action to recover funds not due, Guest shall be liable for reasonable attorney's fees and costs incurred.

GOVERNING LAW

This agreement will be governed by the laws of the State of Idaho, and shall be interpreted, construed and applied in accordance with the laws of the United States of America and the State of Idaho.

AGREEMENT

Guest certifies that he/she has read and agrees to abide by the terms of this rental agreement and by signing below is authorizing any outstanding charges remaining after departure to be charged to the credit card (debit cards are not acceptable) on file or provided below.
